DMCA / Copyright

SoundsMp3 respects the intellectual-property rights of others. This page explains how to report material that you believe infringes your copyright, and what happens next.

Last updated:

1. Copyright & DMCA Policy

The audio files, cover images and titles made available through SoundsMp3 may be owned by third parties. Because a recording can be hosted on an external archive rather than on SoundsMp3 servers, we may need to forward a notice to the party that actually controls the copy before it can be removed.

We respond to properly submitted copyright infringement notices. Because we do not own every item in the catalogue, we do not adjudicate ownership disputes. Our role is to record valid notices, pass them to whoever hosts the material, and disable access to affected items on SoundsMp3 where we are able to do so.

2. Copyright Infringement Notice

A notice must be in writing and must include all of the following:

  1. Identification of the copyrighted work. A description of the work you claim has been infringed, together with enough information for us to identify it, such as a title, or a URL and a timestamp if you mean a specific recording.
  2. Identification of the infringing material. The full SoundsMp3 URL for each item you want removed, with enough detail to locate the specific recording, clip or excerpt concerned.
  3. Your contact information. Your full legal name, mailing address, telephone number and email address.
  4. A statement of good faith. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. A statement of accuracy and authority. A statement that the information in the notice is accurate, and that under penalty of perjury you are the owner of the copyright, or are authorised to act on the owner's behalf.
  6. Your signature. Your physical or electronic signature. Where an agent submits the notice, include the agent's signature and a statement of their authority to act for the copyright owner.

A request such as "I am the artist and this is unfair" is not a notice, because it does not include the statements listed above. If you are unsure whether your notice is sufficient, we recommend seeking legal advice before sending it.

3. Copyright Agent

Copyright notices are handled by the SoundsMP3 copyright contact named in section 8. There is no separate registration or filing process: send your notice by email to the address below using the subject line "DMCA Notice". If a dedicated copyright agent is designated in future, its full details will be published on this page.

4. How to Submit a Notice

Email the complete notice to the address below using the subject line "DMCA Notice". Please keep the notice in the body of the message or attach it as a plain-text or PDF file, and make sure the required information survives that formatting.

We cannot process a notice that exists only as an image, a screenshot or a scan, because the required statements and signature must be verifiable as text. Email is the fastest and most reliable way to submit a complete notice.

5. What Happens After You Submit a Notice

  1. We acknowledge receipt of the notice and record it against the item concerned.
  2. We review the notice for completeness, including the statements and signature required in section 2.
  3. If the material is hosted on SoundsMp3, we remove access to it or disable the affected listing. If it is hosted externally, we forward the notice to the host that stores it and ask that host to act on it. We do not control external hosts, and they may respond to you directly.
  4. We notify the source associated with the item, where we can identify one, that a notice was received.

Removing material does not waive any of our rights. We may restore a file if a notice is withdrawn, is found to be defective, or a counter-notification is accepted.

6. Counter-Notification

If your material was removed and you believe the removal was a mistake or a misidentification, you may submit a counter-notification to the address below using the subject line "DMCA Counter-Notification". It must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number, and your agreement to accept service of process from the person who filed the original notice.

If we receive a valid counter-notification we will forward it to the original complainant. Unless they tell us that they have filed a court action seeking to restrain the activity, we may restore the removed material after 10 business days, at our discretion.

7. Warning: False or Misleading Claims

Under 17 U.S.C. section 512(f), a person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and legal fees incurred by the alleged infringer, by us, and by the copyright owner.

Please do not use this process to intimidate a competitor, to suppress content you dislike, or to remove a recording simply because you would rather it were not there. Send a notice only if you have a good-faith belief that the use is not authorised and you are the rights holder, or authorised to act for them.
